Terms of Service &
SaaS Master Agreement
Please read these Terms of Service carefully before accessing or using the FanpageInsight platform, analytics telemetry, or APIs.
1. Introduction & Acceptance of Terms
These Terms of Service ("Agreement" or "Terms") constitute a legally binding contract between you (either an individual or a legal entity, "Customer", "you", or "your") and FanpageInsight Inc. ("FI", "Company", "we", "us", or "our"), with registered principal offices located at 650 University Ave #10, Berkeley, CA 94710, United States, Phone: (510) 646-8368.
By creating an account, initiating a trial, clicking "I Agree", or accessing the FanpageInsight software-as-a-service platform (the "Platform"), you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy and Data Processing Agreement (DPA).
2. Description of Services & Platform Access
FI provides a proprietary cloud-based social intelligence platform that analyzes publicly accessible Facebook graph data, post engagement metrics, historical performance velocity, competitive benchmarking, and AI-driven commercial intent classification.
Subject to your ongoing compliance with this Agreement and timely payment of applicable subscription fees, FI grants you a non-exclusive, non-transferable, non-sublicensable, revocable worldwide right to access and use the Platform solely for your internal business intelligence and marketing analytics purposes.
3. Account Registration & Security
To access Platform features, you must register for an account by providing accurate, complete, and current corporate contact information. You are solely responsible for maintaining the confidentiality of your credentials and Single Sign-On (SSO) authentication. You must promptly notify FI at security@FanpageInsight.com upon discovering any unauthorized account access.
4. Permitted Use, Ethics & Prohibited Conduct
You agree that you will not, and will not authorize any third party to:
- Use the Platform or its data to conduct unsolicited bulk spamming, harassment, or unlawful outreach.
- Reverse engineer, decompile, disassemble, or derive source code from FI algorithms or proprietary models.
- Circumvent rate limits, quotas, credit access controls, or security barriers implemented on the Platform.
- Resell, lease, or distribute raw bulk telemetry data to unauthorized third-party broker networks.
5. Subscription Plans, Billing & Cancellation
The Platform is offered on a self-serve subscription basis (Startup, Business, Agency, or Enterprise custom tiers). Fees are billed in advance on a recurring monthly or annual basis via authorized credit card or corporate invoice.
Free Trial: All new accounts receive a 3-day complimentary trial with zero credit card required. Upon expiration, accounts transition into read-only access until an active plan is selected.
Cancellation: You may cancel your subscription at any time directly through your account billing settings. Cancellation takes effect at the end of the current paid billing cycle. FI does not issue retroactive refunds for partially unused monthly cycles.
6. Intellectual Property & Customer Data
FI and its licensors retain all right, title, and interest (including all patent, copyright, trademark, and trade secret rights) in and to the Platform, UI designs, algorithms, and documentation.
Customer Data: Customer retains full ownership of all custom notes, tags, client workspace assignments, and generated presentation exports. Customer grants FI a limited license to process Customer Data solely to deliver, secure, and maintain the Platform.
7. Service Availability & Disclaimer of Warranties
FI targets 99.9% service availability across core APIs and dashboards. However, except as explicitly set forth in an Enterprise Service Level Agreement (SLA), the services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, statutory, or implied.
8. Limitation of Liability
To the maximum extent permitted by applicable law, neither party shall be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill). FI’s total aggregate liability arising out of or related to this Agreement shall not exceed the total fees paid by Customer to FI in the twelve (12) months preceding the incident.
9. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be resolved through confidential binding arbitration administered in Alameda County or San Francisco, California.
